{"id":298,"date":"2018-09-03T13:58:18","date_gmt":"2018-09-03T13:58:18","guid":{"rendered":"https:\/\/isquaredemo.com\/MLT\/threegraceslegal\/working-mums-awarded-16000-for-sex-discrimination\/"},"modified":"2025-11-07T13:03:20","modified_gmt":"2025-11-07T13:03:20","slug":"working-mums-awarded-16000-for-sex-discrimination","status":"publish","type":"post","link":"https:\/\/isquaredemo.com\/MLT\/threegraceslegal\/news\/working-mums-awarded-16000-for-sex-discrimination\/","title":{"rendered":"\u201cWORKING MUMS\u201d AWARDED \u00a316,000 FOR SEX DISCRIMINATION."},"content":{"rendered":"\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/isquaredemo.com\/MLT\/threegraceslegal\/wp-content\/uploads\/2025\/10\/SWP_Fig_1_AHRC.jpg\" alt=\"working mums awarded 16,000 for sex discrimination\" title=\"working mums awarded 16,000 for sex discrimination\"\/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Essex-based Dental nurses, Billie-Jo Janes and Jessica Rowley have recently been awarded a total of \u00a316,000 for unfair redundancy, due to their inability to work full-time, as working mothers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In July 2017, the two women were informed of their redundancy, with the explanation that their employer had no need for part-time workers, and as working mums they could not adhere to the dental practices demands.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Both Miss Janes and Miss Rowley contacted their union, Unite, working together to bring the surgery to an Employment Tribunal, after being offered insufficient compensation from the surgery.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The employer was taken to an employment tribunal for unfair dismissal regarding gender discrimination, where Judge Foxwell ruled that the dental practice was guilty of <strong><em>\u201cunlawful indirect sex discrimination\u201d<\/em><\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Employment Tribunal awarded a pay-out each of \u00a36,000 plus \u00a3498 interest for <strong><em>\u201cinjury to feelings for unlawful indirect sex discrimination\u201d,<\/em><\/strong> with added payments for statutory rights and loss earnings, resulting in a total of \u00a37,500 awarded to Miss Jane, 26 and \u00a38,159 awarded to Miss Rowley, 29.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After the ruling, Miss Rowley, who has now found a position at another dental surgery, stated:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>\u201cIt was shocking to get anywhere near money like that, but it just shows how wrong it was.<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>It is a female dominated job but our argument was he made us redundant because we couldn\u2019t do full time hours.<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>We both need to work part-time hours, we both have young children. The owner didn\u2019t want any part-time workers, especially working mums because they were an inconvenience to them.\u201d<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Miss Janes, who has also found a new dental nurse position, described the award as \u201clife-changing\u201d, and intends to save the majority of the money, whilst also treating her daughter to a holiday.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Dental Practice\u2019s Manager, Jeanette Warner admitted that the legal action was a surprising <strong><em>\u201cbolt out of the blue\u201d<\/em><\/strong>, as she believed their departure was <strong><em>\u201camicable\u201d<\/em><\/strong>, however she did acknowledge their wrong-doings, stating:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>\u201cWe made a mistake of not having a meeting with them beforehand to say they might be made redundant.
