dismissal claims are amongst the most common.\u00a0 Our fee structure for dismissal claims should serves as a basic guide to our employment litigation fees generally and of the stages of employment tribunal litigation.\u00a0\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5ede3c3 elementor-widget elementor-widget-text-editor\" data-id=\"5ede3c3\" claim as set out below.\u00a0 It is important to note that the stages are merely an indication and if some of stages are not required, the fees will be reduced separate remedy hearing in required i.e. to work out the level of financial award to be made<\/li><li>Making or defending a cost application<\/li><li>Complex preliminary issues such as whether a claim has been brought in time, whether the individual is an employee, whether the case is sufficiently strong or should be stuck out<\/li><li>Preliminary hearings to determine the preliminary issues<\/li><li>Making or defending applications to amend claims or provide further information about existing claims<\/li><li>Defending claims brought by litigants in person, without professional representation<\/li><li>Long history associated with the claim<\/li><li>Significant amounts of evidence needed to consider and documentation to prepare for hearings<\/li><li>Numerous witnesses called etc.<\/li><li>Barrister fees for conference meetings, written opinion, attending hearing. Barristers fees can average between \u00a3500 \u2013 2000 per day (excluding VAT)<\/li><li>Expert fees such as for a medical report.<\/li><li>Employment Tribunal Costs Orders made against a client.<\/li><li>Appeal costs.<\/li><li>Drafting and advising on settlement agreements<\/li><li>The Enforcement of any order.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2196ba2 elementor-widget elementor-widget-heading\" data-id=\"2196ba2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">How long will my matter take?\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-36c27524 elementor-widget elementor-widget-text-editor\" data-id=\"36c27524\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The time that it takes from taking your initial instructions to the final resolution of your matter depends largely on the stage at which your case is resolved. Before a claim is started, pre-claim conciliation must be attempted to try and settle the matter without resorting to litigation.\u00a0 It must be started within three months of the complaint arising and is normally concluded within four weeks.\u00a0 If settlement isn\u2019t reached then dependent upon when pre-conciliation is concluded, the claimant can have up to a month thereafter to submit a claim to the Tribunal.\u00a0 The average time to the final hearing is 30 weeks.
