Originally devised by Article 29 Working Party to transfer secure large data internationally while reducing bureaucracy.\u00a0<a href=\"https:\/\/isquaredemo.com\/MLT\/threegraceslegal\/business\/data-protection-gdpr\">GDPR<\/a>\u00a0establishes conditions for member states to establish own BCRs to streamline international transfers.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9ff604a elementor-widget elementor-widget-text-editor\" data-id=\"9ff604a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>Cross-border processing<\/strong>:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-db6fbbf elementor-widget elementor-widget-text-editor\" data-id=\"db6fbbf\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>(a) processing personal data in establishment of more than one member state of the controller or processor where controller or processor is established in more than one member state; or<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-cabea4c elementor-widget elementor-widget-text-editor\" data-id=\"cabea4c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>(b) processing personal data in single establishment of controller or processor but is likely or does substantially affect data subjects in more than one member state.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-eba3a61 elementor-widget elementor-widget-text-editor\" data-id=\"eba3a61\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>Health data<\/strong>: awarded particular protections under regulation; additional restrictions as to how it is processed; level of consent required for processing. Member state permitted to introduce further restrictions.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fc15e3a elementor-widget elementor-widget-text-editor\" data-id=\"fc15e3a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>Data controller<\/strong>: natural or legal person, public authority, agency or other body, determines purposes and means of processing personal data. Usually public-facing entities like hospitals \u2013 online health questionnaire, the hospital would be the data controller.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9786e37 elementor-widget elementor-widget-text-editor\" data-id=\"9786e37\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>Data processor<\/strong>: natural or legal person, public authority, agency or other body, processes personal data on behalf of controller. Online health questionnaire form provider will be data processor as act of collecting data.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a66ffa1 elementor-widget elementor-widget-text-editor\" data-id=\"a66ffa1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>In many cases, the controller and processor will be the same entity.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-42b63290 elementor-widget elementor-widget-text-editor\" data-id=\"42b63290\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>Processing<\/strong>: operation performed on personal data such as collecting, recording, organising, structuring, storing, adapting, altering, retrieving, consulting, using, disclosing by transmission, disseminating, aligning, combining, restricting, erasing and destruction.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bdc8106 elementor-widget elementor-widget-text-editor\" data-id=\"bdc8106\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>Profiling<\/strong>: automated processing of personal data to evaluate certain aspects, e.g. performance at work, economic situation, health, etc. The data subject must always be informed of any profiling processes that will be performed before they consent.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-48198f1 elementor-widget elementor-widget-text-editor\" data-id=\"48198f1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>Representative<\/strong>: natural or legal person established in the Union who is designated by controller or processor under Art 27 to represent the controller or processor regarding their respective regulatory obligations.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b369008 elementor-widget elementor-widget-text-editor\" data-id=\"b369008\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Organisations (both controller and processor) not in the EU but that wish to conduct processing in line with Art 27 must appoint a representative established in the EU to ensure the personal data collection and processing has presence within Union and ready contact with authorities.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-17d8bd2f elementor-widget elementor-widget-text-editor\" data-id=\"17d8bd2f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>Supervisory authority<\/strong>: independent public authority established by a member state under Art 51.
