A badly written opt-out buried in terms and conditions is not consent.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-60220115 elementor-widget elementor-widget-heading\" data-id=\"60220115\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">When is consent given?\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1ae22fc elementor-widget elementor-widget-text-editor\" data-id=\"1ae22fc\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The 1995 Data Protection Directive defines consent as:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2589105 elementor-widget elementor-widget-text-editor\" data-id=\"2589105\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>\u201cany freely given specific and informed indication of his wishes by which the data subject signifies his agreement to personal data relating to him being processed\u201d<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-47700be elementor-widget elementor-widget-text-editor\" data-id=\"47700be\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>and<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-96b439c elementor-widget elementor-widget-text-editor\" data-id=\"96b439c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>\u201cthe data subject has unambiguously given his consent\u201d<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5d523e1 elementor-widget elementor-widget-text-editor\" data-id=\"5d523e1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>By contrast,\u00a0<a href=\"https:\/\/isquaredemo.com\/MLT\/threegraceslegal\/business\/data-protection-gdpr\">GDPR<\/a>\u00a0requires consent to be \u2018demonstrable\u2019. It states explicitly that consent can only be obtained by a \u2018statement or by a clear affirmative action\u2019.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9206399 elementor-widget elementor-widget-text-editor\" data-id=\"9206399\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The Privacy and Electronic Communications Regulations (PECR), which is based on Directive 2002\/58\/EC (often known the ePrivacy Directive), defines consent as that which comes from the Data Protection Directive, and so the consent under ePrivacy must be unambiguous, freely given, specific and informed.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e34270e elementor-widget elementor-widget-text-editor\" data-id=\"e34270e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Therefore, where emails are sent, PECR says that the recipient must have \u201cpreviously notified the sender that he consents for the time being to such communications being sent by, or at the instigation of, the sender\u201d.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d010dba elementor-widget elementor-widget-text-editor\" data-id=\"d010dba\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Quite simply, if you have consent to send emails, you don\u2019t need to ask again. If, however, you do not have freely given, specific, informed and unambiguous consent, then do not send.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6d64744 elementor-widget elementor-widget-text-editor\" data-id=\"6d64744\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>However, it would not be unlawful to write to your contacts and ask for consent, because post is not electronic so PECR is not applicable.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d0ce1d7 elementor-widget elementor-widget-text-editor\" data-id=\"d0ce1d7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Sending emails to people who have not opted-in is unlawful unless you have \u2018soft opt-in\u2019 (i.e. previous customers).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c4066cd elementor-widget elementor-widget-heading\" data-id=\"c4066cd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Marketing data gathered prior to May 25, 2018\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-302e777b elementor-widget elementor-widget-text-editor\" data-id=\"302e777b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Imagine the scenario: you hold marketing data, collected from lead generation firms, meetings, seminars etc maintained as a contacts database for marketing purposes. You have already contacted some of the people on this database, but others you have not.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3c74a39 elementor-widget elementor-widget-text-editor\" data-id=\"3c74a39\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>How will this be affected by GDPR?<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-dfeff7a elementor-widget elementor-widget-text-editor\" data-id=\"dfeff7a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Will you need to contact all the earlier contacts to get consent?<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8b54d72 elementor-widget elementor-widget-text-editor\" data-id=\"8b54d72\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Could this be deemed legitimate business use?<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f776a73 elementor-widget elementor-widget-text-editor\" data-id=\"f776a73\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>In summary<\/strong>:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8a18334 elementor-widget elementor-widget-text-editor\" data-id=\"8a18334\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>For everyone you already have consent from, carry on marketing to them.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d4ae4a5 elementor-widget elementor-widget-text-editor\" data-id=\"d4ae4a5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>For anyone you do not have consent from, do not market to them.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-af13180 elementor-widget elementor-widget-text-editor\" data-id=\"af13180\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The budget airline, Flybe, were fined because they still contacted those who had explicitly opted out, asking if they wish to opt back in, while Honda were unable to demonstrate whether or not it had consent to contact individuals. If you are not sure, then it is safer to assume that you don\u2019t have consent.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1d4e4d5 elementor-widget elementor-widget-text-editor\" data-id=\"1d4e4d5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The objective is to re-affirm consent in a GDPR-compliant way which must be done prior to 25 May 2018 and to be valid thereafter.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-29f0258 elementor-widget elementor-widget-text-editor\" data-id=\"29f0258\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>After 25 May 2018, you can only contact people for marketing purposes, and this includes confirming marketing preferences, from those whom you have obtained consent from in a GDPR-compliant way which you can demonstrate.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-79f648ce elementor-widget elementor-widget-heading\" data-id=\"79f648ce\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Obtaining consent\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-46a40767 elementor-widget elementor-widget-text-editor\" data-id=\"46a40767\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>When seeking to acquire informed consent, then the default solution tends to be that you can obtain written consent from each and every customer. This is of course perfectly fine if it is manageable. But even overcoming this task leaves the burden of gathering the consent documents and filing them, and then ensuring the data is correct, etc.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ad0510b elementor-widget elementor-widget-text-editor\" data-id=\"ad0510b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Remember, consent is just one of the ways in which processing data might be justified. Therefore, consider the processes that you are seeking consent to carry out and look at alternative lawful bases.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4c9675b elementor-widget elementor-widget-text-editor\" data-id=\"4c9675b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>If, for example, a library lends books to a member of the library, this could this be covered by \u2018contract\u2019.
