This raises the risk profile of the data set.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6d21023 elementor-widget elementor-widget-text-editor\" data-id=\"6d21023\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>For personal data that does not fall into one of either:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-679c80b elementor-widget elementor-widget-text-editor\" data-id=\"679c80b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<ul><li>child data under Article 8;<\/li><li>special Classes of Data under Article 9 (which adds biometric data and removes convictions data from the old DPA 1998); or<\/li><li>convictions data under Article 10<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7294c09 elementor-widget elementor-widget-text-editor\" data-id=\"7294c09\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>then the controller will need to refer to the categories and types of data it uses to make sense of its information asset inventory and make sure processors can maintain that view for data they hold on the controller\u2019s behalf.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6f48e851 elementor-widget elementor-widget-heading\" data-id=\"6f48e851\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Types and categories of data\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7fbeadf elementor-widget elementor-widget-text-editor\" data-id=\"7fbeadf\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>When looking at the meanings of &#8216;type&#8217; of personal data, in the context of Article 28(3) and Recital 81, and &#8216;category&#8217;, it is helpful to differentiate in the following terms:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7399b1c elementor-widget elementor-widget-text-editor\" data-id=\"7399b1c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<table>\n<tbody>\n<tr>\n<td style=\"width: 302px;\">\n<p><strong>\u2018Type\u2019<\/strong><\/p>\n<\/td>\n<td style=\"width: 302px;\">\n<p><strong>\u2018Category\u2019<\/strong><\/p>\n<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 302px;\">\n<p>Format, i.e. paper files, online profiles, etc.<\/p>\n<\/td>\n<td style=\"width: 302px;\">\n<p>Personal v sensitive, i.e. address v health data<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 302px;\">\n<p>Which data or data categories are processed<\/p>\n<\/td>\n<td style=\"width: 302px;\">\n<p>\u2018HR leaders\u2019 or \u2018Team Leaders\u2019 would be category of recipients<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 302px;\">\n<p>Type of data may be regular or special type<\/p>\n<\/td>\n<td style=\"width: 302px;\">\n<p>Category of affected persons is customers or employees, etc.<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td style=\"width: 302px;\">&nbsp;<\/td>\n<td style=\"width: 302px;\">\n<p>Category of data is master data, payroll data, health data, etc.<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-75e2d9cb elementor-widget elementor-widget-heading\" data-id=\"75e2d9cb\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Rules for the processor\u2019s contract with the controller\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6cc2c34a elementor-widget elementor-widget-text-editor\" data-id=\"6cc2c34a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Article 28(3) is in the context of a processor&#8217;s contract with the controller. The type of personal information has to be stated and can be: collected, observed, derived and special category. Article 28(3) (h) states the processor must ensure it: &#8220;makes available to the controller all information necessary to demonstrate compliance with the obligations laid down in this Article&#8230;&#8221;, namely a report must be sourced.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0f8595e elementor-widget elementor-widget-text-editor\" data-id=\"0f8595e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The controller contract with a processor should not reveal any more about the structure of the data being provided than is needed for the processor to comply with its legal responsibilities. If the controller wishes to provide further information that the processor might require in order to carry out the technical tasks requested of it, then this should be provided in a separate document with a restricted circulation list.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-21ba96e elementor-widget elementor-widget-text-editor\" data-id=\"21ba96e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Finally, it may be necessary to provide the controller with technical requirements and details to complement a Service Level Agreement.
