Our lowest hourly rate is \u00a3100 and our highest hourly rate is \u00a3375. The seniority of the members of staff dealing with your case will depend on its complexity. We will discuss this with you when you instruct us.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-559527f elementor-widget elementor-widget-heading\" data-id=\"559527f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Factors that could make a case more complex:<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3d19752 elementor-widget elementor-widget-text-editor\" data-id=\"3d19752\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li>If it is necessary to make or defend applications to amend claims or to provide further information about an existing claim<\/li><li>Defending claims that are brought by litigants in person<\/li><li>Making or defending a costs application<\/li><li>Complex preliminary issues such as whether the claimant is disabled, where this is not agreed by the parties<\/li><li>The number of witnesses and documents<\/li><li>If it is an automatic unfair dismissal claim e.g. if you are dismissed after blowing the whistle on your employer<\/li><li>Allegations of discrimination which are linked to the dismissal<\/li><\/ul><p>There will be an additional charge if attending a Tribunal Hearing is required. Many cases settle without a hearing, but in cases where one is required they usually take between 1 and 5 days. We handle the payment of the disbursements on your behalf, once placed in funds, to ensure a smoother process.<\/p><p>Counsel&#8217;s fees estimated between \u00a3500 to \u00a32,000 per day excluding VAT, charged at 20% (depending on experience of the advocate) for attending a Tribunal Hearing (including preparation)<\/p><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8c76d74 elementor-widget elementor-widget-heading\" data-id=\"8c76d74\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Key stages<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-95f72b0 elementor-widget elementor-widget-text-editor\" data-id=\"95f72b0\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li><p>The fees set out above cover all of the work in relation to the following key stages of a claim:<\/p><ul><li>Taking your initial instructions, reviewing the papers and advising you on merits and likely compensation (this is likely to be revisited throughout the matter and subject to change)<\/li><li>Entering into pre-claim conciliation where this is mandatory to explore whether a settlement can be reached<\/li><li>Preparing claim or response<\/li><li>Reviewing and advising on claim or response from other party<\/li><li>Exploring settlement and negotiating settlement throughout the process<\/li><li>Preparing or considering a schedule of loss<\/li><li>Preparing for (and attending) a Preliminary Hearing<\/li><li>Exchanging documents with the other party and agreeing a bundle of documents<\/li><li>Taking witness statements, drafting statements and agreeing their content with witnesses<\/li><li>Preparing bundle of documents<\/li><li>Reviewing and advising on the other party&#8217;s witness statements<\/li><li>Agreeing a list of issues, a chronology and\/or cast list<\/li><li>Preparation and attendance at Final Hearing, including brief to Counsel<\/li><\/ul><p>The stages set out above are an indication and if some of stages above are not required, the fee will be reduced. You may wish to handle the claim yourself and only have our advice in relation to some of the stages. If a settlement is reached during pre-claim conciliation, your case is likely to take 6-12 weeks. If your claim proceeds to a Final Hearing, your case is likely to take 6-18 months, subject to the judge\u2019s availability. This is just an estimate and we will of course be able to give you a more accurate timescale once we have more information and as the matter progresses.<\/p><p><strong>The above are estimates, not fixed fees. I looked at various firms but what I liked about ScoMo was its ethos and the calibre of its lawyers, a number of whom are highly respected in their area of law. I also liked the fact that ScoMo would be responsible for much of the admin involved such as providing indemnity insurance, dealing with regulatory bodies, accounts and archiving etc. Also, the consultancy agreement was straightforward, i.e. the consultant retained most of their fees regardless of income for a given year unlike other firms which operate on a sliding scale.<br \/>Scott-Moncrieff provides a cloud-based integrated case management and email system which means that files can be accessed anywhere online securely as the system is maintained and backed up centrally and nothing needs to be stored on a consultant\u2019s own computer. ScoMo has provided me with the necessary support when I have needed it and consultants are happy to assist each other. Since joining ScoMo in 2011, I have not looked back. If a lawyer is self-reliant and confident of generating their own work, I can recommend working as a self-employed consultant lawyer and from my own experience I would highly recommend working for
