Those left behind can find it hard to deal with the various issues that need to be sorted following a death, at the same time as coping with their grief. However, the situation can be even more complicated where an inquest is required.\u00a0<a href=\"https:\/\/isquaredemo.com\/MLT\/scomo\/services-for-you\/inquests\">Inquests<\/a>\u00a0are used in situations where the death was:<\/p><ul><li>Sudden, unexpected, violent or unnatural.<\/li><li>The death cannot be determined after a post mortem.<\/li><li>The death occurred in prison or police custody.<\/li><li>The death involved a private organisation.<\/li><\/ul><p>Here we look at the process involved during an inquest and what to expect as a result of one.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ad7dd03 elementor-widget elementor-widget-heading\" data-id=\"ad7dd03\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">The purpose of an inquest<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1d9672d elementor-widget elementor-widget-text-editor\" data-id=\"1d9672d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The purpose of an inquest is not to apportion blame or liability but to confirm how death occurred. The main questions that need to be answered are:<\/p><ul><li>Who the deceased person was<\/li><li>Where the death happened<\/li><li>When the death happened<\/li><li>How the deceased died.<\/li><\/ul><p>The coroner uses the answers to the above to give a verdict on the death. Although this is not supposed to be an adversarial hearing, they are technical and often stressful for the family involved, which is why it is recommended in all but the simplest cases to have representation.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-db52756 elementor-widget elementor-widget-heading\" data-id=\"db52756\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">What is the process of an inquest?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3c29098 elementor-widget elementor-widget-text-editor\" data-id=\"3c29098\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The coroner will ask for several lines of enquiries and investigations to be completed and produced for the inquest. The types of information that the coroner will need include:<\/p><ul><li>Witness statements<\/li><li>Medical reports<\/li><li>Expert reports<\/li><li>Any other relevant evidence, such as CCTV<\/li><li>For deaths in police or prison custody, the production of police and custody records<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3ea745d elementor-widget elementor-widget-heading\" data-id=\"3ea745d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Witnesses and properly interest persons<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2532243 elementor-widget elementor-widget-text-editor\" data-id=\"2532243\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>As well as the coroner calling witnesses, other parties will be involved in the case and these people are known as properly interested persons (PIPs). These will be those that are in some way related to the death as well as the family of the deceased. PIPs are entitled to attend the inquest and ask questions of witnesses (this can be via a representative such as a solicitor) as well as having access to all relevant documentation.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-621660d elementor-widget elementor-widget-heading\" data-id=\"621660d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Pre-inquest review<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-85576fc elementor-widget elementor-widget-text-editor\" data-id=\"85576fc\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>A pre-inquest review can be held with the PIPs before the start of the inquest for representations on whether other aspects need to be considered including:<\/p><ul><li>The need for further witnesses.<\/li><li>If further disclosure is required.<\/li><li>Whether there should be additional expert evidence.<\/li><li>If a jury is required.<\/li><li>Whether it should be an Article 2 inquest. This relates to Article 2 of the European Convention of Human Rights, which states that everyone\u2019s right to life shall be protected by law. Under this Article, all State bodies have a duty to take reasonable steps to mitigate any risk where there is a real and immediate risk to life of which they are (or should be) aware.<\/li><\/ul><p>Once these matters are dealt with, the coroner will hold an inquest hearing. This will be used to determine the answers to the above questions surrounding the death.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6088252 elementor-widget elementor-widget-heading\" data-id=\"6088252\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">What conclusions can be made by the coroner?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b0e3356 elementor-widget elementor-widget-text-editor\" data-id=\"b0e3356\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The coroner will hear from various witnesses, who can be questioned by the coroner, as well as by any PIPs or their representatives. At the end of the hearing, the coroner (or jury where appropriate) will give a conclusion based on what they have heard. This decision will be included in the deceased death certificate. Various conclusions can be made at the end of the hearing, including:<\/p><ul><li>Suicide<\/li><li>Unlawful\/ lawful killing<\/li><li>Accident or misadventure<\/li><li>Drugs or alcohol misuse<\/li><li>Industrial disease or poisoning<\/li><li>Road traffic accident<\/li><li>Stillbirth<\/li><li>Natural causes<\/li><li>Open conclusion<\/li><li>Narrative- this is a factual description of the facts without naming individuals or using phrases that would imply criminal or civil liability.
